  • 1 year labor warranty (for defects, mistakes fence falling apart, etc). Does not cover fence settling (fence sinking due to uncompressed ground, more common in new developments)

Our Product Warranties

NVP Fence Warranty

LIMITED LIFETIME WARRANTY

National Vinyl Products, LLC (NVP) warrants that products are free from defects in material and manufacturing workmanship. When installed properly, and under normal and proper use, NVP products will not peel, rot, blister, rust, flake, corrode or be consumed by insects, incur abnormal discoloration or abnormal weathering. If any such defect or degradation occurs as a result of material or manufacturing workmanship, NVP will replace the defective material. NVP shall be the sole judge in determining whether the problem is due to a defect in manufacturing.

The lifetime coverage of this warranty only covers NVP products used on freestanding, detached residential property during the owner’s lifetime while residing at and owning such property. The coverage may be transferred upon the terms and conditions described below. The warranty period for products installed on property that is not freestanding, detached residential property where the owner resides, including but not limited to schools, condominiums, apartment buildings and rental property – or on property owned by other owners including but not limited to corporations, government agencies, partnerships, trusts, religious organizations and cooperatives will be the lesser of thirty (30) years following the installation of the products, or the period ending when the property is sold, and is therefore limited to the original owner (non- transferable).

This warranty remains in effect for the lifetime of the original purchaser, until the sale of the real property where the product is installed, or until the death of the original purchaser, whichever occurs first. However, this warranty is transferable by the original purchaser/real property owner where NVP products were installed, to one subsequent owner of such real property, provided that (1) NVP receives a written request for transfer within thirty (30) days of real property title transfer, (2) each legal owner of the real property retains the original or a certified copy of the original bill of sale for the product purchase and (3) a $100 transfer fee has been made payable to NVP. Failure to comply with these requirements for transfer will relieve NVP of any further liability or obligation under this warranty. Upon a transfer meeting the requirements described in this paragraph to the first subsequent owner, term of this warranty shall convert to a 30-year limited warranty, with the starting date concurrent with the original purchase date.

Limitations:

This warranty specifically excludes any defect or degradation of, or damage to, products caused by any one or more of the following: settlement, soil movement, failure of any structure upon which product is installed, gates, gate adjustments, hardware (including damage to the product caused by the improper use, design or installation of gate hardware), fasteners, misuse, impact of foreign objects (including large animals and horses), painting, varnishing or coating the products, intentional or negligent acts of damage, fire, wind, flood, hail, lightning or other acts of God, excessive environmental conditions, unreasonable use, neglect, alterations, improper installation, improper care or failure to provide reasonable and necessary upkeep, maintenance or repair of the product, normal and expected weathering of the surface of the product. The applicability of any of the foregoing limitations will be determined in the sole discretion of NVP. The purchaser acknowledges that all NVP products exposed to the elements for a sustained period will experience gradual and generally uniform changes in appearance, such as chalking, fading or accumulation of dirt and stains. The degree of weathering depends on the intensity, duration and orientation of exposure to UV rays, as well as elements such as air pollution, hard water and fertilizers. NVP warrants that our product will weather in a generally ‘uniform’ and ‘consistent’ manner in accordance with the ASTM Specification F964

Such weathering is not a defect and is not covered by this warranty. These changes are only considered to be a defect if variances manifest differently from one portion of the fence to another which has uniformly had the same time exposure to the elements. Color variances will also be manifest if a portion of the fence is replaced with new pieces or sections – when compared to pieces or sections which remain and have had longer exposure to the elements. This warranty also excludes warping or distortion or any other damage due to exposure to excessive heat sources (barbecue grills, space heaters, fireplaces, open flames, etc.), or exposure to exceptional conditions of intense heat from reflective surfaces.

Claims:

Any claim under this warranty must be made in writing during the applicable warranty period and delivered to NVP, with such claim reasonably describing the claimed defect and including such supporting information as is necessary for NVP to assess the claim. NVP will be allowed a reasonable period for inspection of any product that is the subject of a claim hereunder. NVP reserves the right to require disputed material to be sent to NVP’s facility at the purchaser’s expense for testing and inspection.

NVP’s responsibility under this warranty is expressly limited to the terms set forth herein. NVP will not be liable for labor expense, sales tax, delivery charges or other expenses pertaining to the removal, disposal, replacement or installation of either the original or replacement products. Any cost or expense beyond NVP’s liability as described herein shall be the purchaser’s sole responsibility.

NVP reserves the right to discontinue or modify its products without notice. NVP shall not be held liable for changes to its products nor for differences in color or gloss of replacement material in comparison to the original product (according to the standards for weathering per this written warranty statement). In the event that a claim is made for a discontinued or modified product, NVP will, at its option, supply vinyl fence product of equivalent quality and value as the original.

THIS WARRANTY REPLACES ALL OTHER ORAL OR WRITTEN WARRANTIES, LIABILITIES OR OBLIGATIONS OF NVP RELATIVE TO ITS PRODUCTS. NVP EXPRESSLY DISCLAIMS AND LIMITS ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE TO THE EXTENT ALLOWED BY STATE LAW. NVP’S LIABILITY UNDER THIS WARRANTY AND IN ANY MATTER RELATING TO ANY NVP PRODUCT SHALL IN NO EVENT EXCEED THE TOTAL AMOUNT PAID BY PURCHASER FOR SUCH PRODUCT, AND NVP IN EXTINGUISHING ITS LIABILITY SHALL HAVE THE OPTION, IN ITS SOLE DISCRETION, TO REFUND PURCHASER THE AMOUNT PAID FOR SUCH PRODUCT OR TO PROVIDE PURCHASER WITH REPLACEMENT PRODUCT AS DESCRIBED HEREIN.

NVP makes no express warranties except as herein written, and shall not be liable for any incidental, special or consequential damages with respect to its products covered by this warranty, the extent of its liability and the owner’s exclusive remedy being limited to replacement material as set forth herein. Some states may not allow limitations on or exclusion of incidental or consequential damages, so the above exclusions may not apply.

 

SimTek Warranty (Ecostone & Ashland)

What and Who are Covered and for How Long

CertainTeed warrants to the original owner that its Ashland® and EcoStone® fence (Fence Product) will be free from manufacturing defects for twenty-five (25) years (Warranty Period) from when the Fence Product is used and installed in accordance with the applicable CertainTeed instructions.

Should any manufacturing defect occur during the Warranty Period for the original owner, CertainTeed will provide replacement Fence Product for the Fence Product deemed defective by CertainTeed. CertainTeed, at its sole option, also reserves the right to refund the amount paid by the original owner for the Fence Product, excluding any costs of installation. CertainTeed shall not be liable or responsible for labor charges or other expenses whatsoever in connection with removal or installation of either the original or replacement product.

In the event of replacement under the terms of this Warranty, the original warranty shall apply to the replacement Fence Product, and will extend for the balance of the Warranty Period in effect at the time the original product proved defective by CertainTeed.

Residential coverage is designed to cover individual owners of a single-family home. All other properties, such as those owned by corporations, governmental agencies, partnerships, trusts, religious organizations, schools, condominiums, homeowner associations, cooperative housing arrangements, apartments, or any other multi-family property are deemed to be Commercial for purposes of this Warranty.

ColorLast® Fade Protection 10 Years

CertainTeed warrants the Fence Product against excess fade beyond normal weathering if caused by a manufacturing defect and is reported within ten (10) years of installation to CertainTeed in accordance with the notice provision contained in the “What the Customer Must Do” section of this Warranty. Excess fade is defined by a change in color greater than four (4) Hunter units as calculated according to ASTM D2244. If CertainTeed determines that the Fence Product has excess fade, CertainTeed, at its sole option, will either provide replacement Fence Product for the Fence Product that has excess fade or refund the amount paid by the original owner for the Fence Product, excluding any costs of installation, per the terms of this Warranty.

Limitations

This Warranty does not provide protection against any failure, defect or damage caused by situations and events beyond normal exposure conditions, including but not limited to:

  • Misuse, abuse, neglect or improper handling or storage;
  • Improper installation or installation not in strict adherence to CertainTeed’s written instructions;
  • Use of accessories which do not properly receive and/or secure the Fence Product;
  • Impact of foreign objects, fire, earthquake, flood, lightning, hail, hurricane, tornado or other casualty or act of God;
  • Movement, distortion, collapse or settling of the ground or structure on which the Fence Product is installed;
  • Distortion or melting of the Fence Product due to extreme heat sources, including but not limited to, barbeque grills, fires, or as a result of solar reflection from windows, doors or other objects;
  • Damage caused by animals or insects;
  • Any other cause not involving manufacturing defects in the Fence Product.

The Fence Product is not warranted against discoloration or other damage caused by air pollution (including but not limited to metal oxides or metallic particles), mildew, exposure to harmful chemicals or normal weathering from the elements

Normal weathering is defined as exposure to sunlight and extremes of weather and atmosphere which will cause any colored surface to gradually fade, chalk, or accumulate dirt or stains. The severity of any condition depends on the geographical location of the Fence Product, the cleanliness of the air in the area, and many other influences over which CertainTeed has no control.

This Warranty does not apply to and the Warranty voided for Fence Product which has been painted, varnished or coated over the manufacturer’s original finish.

CertainTeed reserves the right to discontinue or modify any of its Fence Products, including the color, without notice to the owner, nor shall CertainTeed be liable in the event the replacement product may vary in color or gloss in comparison to the original product as a result of normal weathering. If CertainTeed replaces or repairs any Fence Product under this Warranty, it may substitute products designated by CertainTeed to be of comparable quality or price range in the event the product initially installed has been discontinued or modified.

Transferability

This Warranty is not transferable.

EXCLUSIVE WARRANTY AND LIMITATION OF REMEDIES

THIS DOCUMENT CONSTITUTES THE EXCLUSIVE WARRANTY AND SOLE REMEDIES PROVIDED BY CERTAINTEED. THE WARRANTY AND REMEDIES CONTAINED IN THIS DOCUMENT ARE EXPRESSLY IN LIEU OF ANY AND ALL OTHER OBLIGATIONS, GUARANTEES, WARRANTIES AND REPRESENTATIONS, WHETHER WRITTEN, ORAL, IMPLIED BY STATUTE, AT LAW OR IN EQUITY, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR USE AND FITNESS FOR A PARTICULAR PURPOSE. SOME STATES OR JURISDICTIONS MAY NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR MAY DETERMINE THE PERIOD OF TIME FOLLOWING THE SALE THAT A PURCHASER MAY SEEK A REMEDY UNDER IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

CERTAINTEED’S OBLIGATIONS, RESPONSIBILITIES AND LIABILITY SHALL BE LIMITED TO PROVIDING REPLACEMENT PRODUCT OR A REFUND AS SET FORTH IN THIS LIMITED WARRANTY. IN NO EVENT SHALL CERTAINTEED BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING ANY DAMAGE TO THE PROPERTY, THE BUILDING OR ITS CONTENTS, OR FOR INJURY TO ANY PERSONS, THAT MAY OCCUR AS A RESULT OF THE USE OF CERTAINTEED’S PRODUCTS OR AS A RESULT OF THE BREACH OF THIS WARRANTY. IF YOUR STATE OR JURISDICTION DOES NOT ALLOW EXCLUSIONS OR LIMITATIONS OF SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN NO EVENT SHALL CERTAINTEED’S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE PRODUCT(S) COVERED UNDER THIS LIMITED WARRANTY EXCEED THE ORIGINAL PURCHASE PRICE OF THE PRODUCT NOT INCLUDING ANY COSTS RELATING TO INSTALLATION OF SUCH PRODUCTS. 

This Warranty gives you specific legal rights and you may have other rights that may vary by state or jurisdiction.

This Warranty may not be modified, altered or expanded by anyone, including product distributors, dealers, sellers, installers and/or CertainTeed field representatives.

What the Customer Must Do

The original owner must promptly notify CertainTeed in writing of any claimed manufacturing defect and provide proof of the date of purchase and installation, as well as proof of property ownership. All notifications should be sent to: CertainTeed Corporation, 803 Belden Road, Jackson, MI 49203, Attn: Consumer Services Department. The owner may be required to submit a sample of the claimed defective material to CertainTeed for analysis. CertainTeed will then investigate the claim and may examine the material claimed to be defective. If a manufacturing defect covered by this Warranty is confirmed by CertainTeed, CertainTeed, within a reasonable amount of time after the investigation, at its sole option, will provide replacement Fence Product or refund the amount paid by the original purchaser for the Fence Product, excluding any costs of installation, per the terms of this Warranty.

Effective Date: This warranty applies to SimTek Fence Products installed on or after January 1, 2019.

 

 

Bufftech Warranty (Allegheny & Sherwood)

What and Who Are Covered and for How Long

CertainTeed warrants to the original owner that its Bufftech® molded and extruded fence products and accents “Fence Products” will be free from manufacturing defects — including peeling, flaking, blistering and corroding — when installed according to CertainTeed’s installation instructions and when subject to normal and proper use. Extruded Fence Products are manufactured using polyvinyl chloride in an extruded process, such as but not limited to Chesterfield; Molded Fence Products are manufactured using polyethylene and are rotationally molded, such as but not limited to Sherwood™.

Should any manufacturing defect occur during the lifetime of the original homeowner (and as long as the original homeowner is still living and retains ownership of the property), CertainTeed will repair or replace, at its sole option, the defective Fence Product. Except for extruded Fence Products, during the SureStart™ protection period, CertainTeed shall not be liable or responsible for labor charges or other expenses whatsoever in connection with removal or installation of either the original or replacement product. CertainTeed also reserves the right to refund the amount paid by the original owner for the Fence Product.

In the event of repair or replacement under the terms of this limited warranty, the original warranty shall apply to the repaired or replacement Fence Product and will extend for the balance of the warranty period in effect at the time the original product proved defective by CertainTeed.

The lifetime coverage offered by this limited warranty automatically ends upon the sale of the property or death of the last of the original owners of the property at the time of installation. The lifetime coverage offered by this limited warranty is designed to cover original individual homeowners only. In the case of Fence Product purchased by or installed upon property owned by corporations, governmental agencies, partnerships, trusts, religious organizations, schools, condominiums, homeowner associations, cooperative housing arrangements, apartment buildings or any other type of building or premises not used by individual homeowners as their residences, the warranty period will be thirty (30) years following the installation of the Fence Product.

Under no circumstances shall the lifetime coverage apply to Fence Product used as common perimeter or common pool fencing. Common perimeter and common pool fencing is covered by a thirty (30) year limited warranty

Special Orders that consist of specially manufactured products that have been custom made to the design and specifications of fence dealers or other third parties have specific warranty coverage terms and conditions. Any claim for warranty coverage made for specially manufactured products will be evaluated by CertainTeed to determine if the cause of any observed issue is related solely to manufacturing defects in the products, which will be covered under the terms of this limited warranty, or as a consequence of the products being specially manufactured or installed to unique specifications. Should CertainTeed determine that the specifications for the specially manufactured products have resulted in any type of performance or design issues of the product, CertainTeed disclaims all warranty coverage for the observed issue.

SureStart™ Protection – Extruded Products Only

CertainTeed extruded Fence Products are covered by SureStart™ protection for a period of five (5) years following the date when installation has been completed. Under this warranty feature, CertainTeed, at no charge, will repair or replace, at its sole option, any fence proven to be defective by CertainTeed during the 5-year SureStart™ period. CertainTeed’s maximum liability under SureStart™ will be equal to the reasonable cost to replace the defective Fence Product at its current value, including the reasonable costs of labor. Fading is excluded from SureStart protection. See ColorLast Fade Protection section for fade coverage.

ColorLast® Fade Protection

CertainTeed warrants the Fence Product against excess fading beyond normal weathering if caused by a manufacturing defect and is reported to CertainTeed in accordance with the notice provision contained in the “What the Customer Must Do” section of this warranty. Excess fade is defined by a change in color greater than four (4) Hunter units as calculated according to ASTM D2244. ColorLast Fade Protection is not available for spindle accents in black. If CertainTeed determines that the Fence Product has excess fade, CertainTeed, at its sole option, will only provide replacement Fence Product or refund the amount paid by the original purchaser for the Fence Product. No labor costs are included with a replacement or refund.

  • Extruded Products – Lifetime

Solar Post Caps

CertainTeed warrants to the original owner that its solar post caps will be free from manufacturing defects when subject to normal and proper use for a period of two (2) years from the date of installation. This warranty does not apply to (a) damage caused by accident, abuse in handling or dropping; (b) acts of God; (c) units that have been subject to unauthorized repair, opening, modification or disassembly; (d) units not used in accordance with CertainTeed instructions; (e) LEDs and batteries; (f) normal wear and tear; (g) the unit finish as a result of scratches or weathering; or (h) any other damage not related to a manufacturing defect. In the event that CertainTeed determines that the solar post cap contains a manufacturing defect within two (2) years after installation, CertainTeed, at its sole option, will repair or replace the affected solar post cap. In no event shall CertainTeed have any liability for the affected solar post cap in excess of the original price paid by the purchaser for the solar post cap

Limitations

This warranty does not provide protection against any failure, defect or damage caused by situations and events beyond normal exposure conditions, including but not limited to:

  • Misuse, abuse, neglect or improper handling or storage; 
  • Improper installation or installation not in strict adherence to CertainTeed’s written instructions, or in the case of a Special Order, prior written approval is granted by CertainTeed for the installation method;
  • Use of accessories that do not properly receive and/or secure the Fence Products; • Impact of foreign objects, fire, earthquake, flood, lightning, hail, hurricane, tornado, excessive wind or other casualty or act of God; 
  • Movement, distortion, collapse or settling of the ground or structure on which the Fence Product is installed;
  • Distortion or melting of the Fence Products due to external heat sources, including but not limited to, barbeque grills, fires or as a result of reflection from windows, doors or other objects; • Any failure, defect or damage of the product, design or performance of Special Orders that CertainTeed determines are related to the specifications for the specially ordered products, including installation specifications;
  • Field-altered or field-cut Fence Products that CertainTeed has determined caused the failure, defect or damage; 
  • Damage caused by animals or insects;
  • Any other cause not involving manufacturing defects in the material supplied by CertainTeed.

Because Special Orders are unique and not otherwise commercially available from CertainTeed, CertainTeed makes no representations or warranties of any nature or kind with respect to the performance of Special Orders once they are installed. CertainTeed disclaims any warranty coverage for specially manufactured products that have defects as a result of the unique specifications of the Special Orders. CertainTeed EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR USE AND FITNESS FOR A PARTICULAR PURPOSE FOR THESE SPECIAL ORDERS.

The Fence Product is not warranted against discoloration or other damage caused by air pollution (including but not limited to metal oxides or metallic particles), mildew, exposure to harmful chemicals or normal weathering from the elements.

Notwithstanding anything set forth above, the Fence Product is warranted against yellowing of the product due to normal weathering from the elements.

This warranty does not apply to and the warranty voided for Fence Product that has been painted, varnished or coated over the manufacturer’s original finish.

CertainTeed’s post and rail fence products provide a reliable enclosure for horses and other livestock. However, these Fence Products are not designed to withstand the physical abuse inflicted by animals determined to break through the Fence Products. Products damaged by horses or contained livestock will be evaluated by CertainTeed for impact performance in compliance with the testing protocol set forth in ASTM Specification F 964, subsection 6.3. Products found by CertainTeed to be in compliance with this performance standard will not be eligible for repair or replacement under this warranty.

CertainTeed reserves the right to discontinue or modify any of its products, including the color, without notice to the owner, nor shall CertainTeed be liable in the event the replacement product may vary in color or gloss in comparison to the original product as a result of weathering. If CertainTeed replaces or repairs any Fence Product under this warranty, it may substitute products designated by CertainTeed to be of comparable quality or price range in the event the product initially installed has been discontinued or modified.

Transferability – Extruded Products Only

This limited warranty is transferable only by original individual homeowners to any subsequent homeowner(s) of the property where the extruded Fence Products were installed, provided that each subsequent homeowner retains the original or a copy of the original bill of sale to the original owner. Lifetime warranty coverage is only available to the original homeowner. In the event of property transfer, the term of this limited warranty will be a maximum of thirty (30) years from the date of original installation of the extruded Fence Products. The limited warranty is not transferable for nonextruded Fence Products.

In the case of any Fence Product purchased by or installed upon property owned by corporations, governmental agencies, partnerships, trusts, religious organizations, schools, condominiums, homeowner associations, cooperative housing arrangements, apartment buildings or any other type of building or premises not used by individual homeowners as their residences, the limited warranty is not transferable.

Exclusive Warranty and Limitations of Remedies

THIS DOCUMENT CONSTITUTES THE EXCLUSIVE WARRANTIES AND REMEDIES PROVIDED BY CERTAINTEED. THE WARRANTIES AND REMEDIES CONTAINED IN THIS DOCUMENT ARE EXPRESSLY IN LIEU OF ANY AND ALL OTHER OBLIGATIONS, GUARANTEES, WARRANTIES AND REPRESENTATIONS, WHETHER WRITTEN, ORAL OR IMPLIED BY STATUTE, AT LAW OR IN EQUITY, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SOME STATES OR PROVINCES MAY NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR MAY DETERMINE THE PERIOD OF TIME FOLLOWING THE SALE THAT A PURCHASER MAY SEEK A REMEDY UNDER IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

CERTAINTEED’S OBLIGATIONS, RESPONSIBILITIES AND LIABILITY SHALL BE LIMITED TO REPAIRING, REPLACING OR REFUNDING THE DEFECTIVE PRODUCT AS SET FORTH IN THIS LIMITED WARRANTY. IN NO EVENT SHALL CERTAINTEED BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING ANY DAMAGE TO THE PROPERTY, THE BUILDING OR ITS CONTENTS OR FOR INJURY TO ANY PERSONS, THAT MAY OCCUR AS A RESULT OF THE USE OF CERTAINTEED’S PRODUCTS OR AS A RESULT OF THE BREACH OF THIS WARRANTY. IF YOUR STATE OR PROVINCE DOES NOT ALLOW EXCLUSIONS OR LIMITATIONS OF SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

This limited warranty gives you specific legal rights and you also may have other rights that may vary from state to state.

Except for Special Orders, this limited warranty may not be modified, altered or expanded by anyone, including product distributors, dealers, sellers, installers and/or CertainTeed field representatives.

What the Customer Must Do

The owner must notify CertainTeed promptly in writing of any manufacturing defect and provide proof of the date of purchase and installation, as well as proof of property ownership. All notifications should be sent to: CertainTeed LLC, 803 Belden Road, Jackson, MI 49203, Attn: Consumer Services Department. The owner may be required to submit a sample of the claimed defective material to CertainTeed for analysis. CertainTeed will then investigate the claim and may examine the material claimed to be defective. If a manufacturing defect covered by this warranty is confirmed by CertainTeed, CertainTeed, within a reasonable amount of time after the investigation, will, at its sole option, repair or replace the fence product, or refund the amount paid by the original purchaser for the Fence Product and accessories, per the terms of this limited warranty.

This limited warranty is effective for products purchased on or after November 1, 2019. 

Alumi-Guard Limited Warranty

Transferable Limited Lifetime Warranty

Who is covered:

  • The limited lifetime warranty covers single-family residential properties only. This limited warranty extends to the original purchaser and one (1) individual transferee as specified herein.
  •  thirty (30) year limited warranty covers any other type of building or property including those owned by corporations, governmental agencies, partnerships, trusts, religious organizations, schools, condominiums, homeowner associations, cooperative housing arrangements and apartment buildings. The warranty period will be thirty (30) years following the original date of Product purchase.

Aluminum – What is covered: Barrette Outdoor Living warrants that its aluminum fencing products (“Product”) will be free from defects in material and workmanship for the warranty period. This limited warranty is valid beginning on the date of Product purchase.

Barrette Outdoor Living warrants the Product against peeling, flaking, rotting, chipping, cracking, blistering, splintering, corrosion and rusting; or abnormal discoloration/fading* under normal atmosphere and weather conditions.

*After prolonged exposure to outdoor environments, all products will experience some gradual fading over time and is considered normal (up to a standard variation determined by Delta E color measurement, not to exceed Delta 5). Degrees of fading vary depending on geographical location, air pollution, exposure and other factors.

What this warranty does not cover: This limited warranty does not cover damage resulting from: misuse, abuse, improper storage or handling, improper installation, other aluminum products and accessories that are not manufactured by Barrette Outdoor Living, or manufactured for specific use in aluminum fence applications; damage caused by events beyond human control including but not limited to damage caused by animals or natural events; impact of foreign objects, fire, earthquake, flood, lightning, hail, hurricane, tornado or other casualty or act of God; movements, distortion, collapse or settling of ground or structure on which the fence is installed. This limited warranty does not cover costs of removal or disposal of product, or reinstallation of replacement product.

What Barrette Outdoor Living does to remedy the problem: Should your Barrette Outdoor Living product prove defective under warranty, visit the website or call the phone number listed below. Barrette Outdoor Living requires written notice or phone call within thirty (30) days of discovering the defect and you must show original proof of purchase receipt. You will be required to provide to Barrette Outdoor Living pictures and/or samples of the defective Product. If it is determined by Barrette Outdoor Living, in its sole discretion, the Product has a manufacturer defect in material or workmanship, Barrette Outdoor Living will replace with new or equivalent products; labor is not included in warranty. If the Product is discontinued, Barrette Outdoor Living will repair or replace the Product with a product in comparable quality or price range.

Barrette Outdoor Living reserves the right to discontinue or modify any of its products, including the color of its products without notice to the purchaser. Barrette Outdoor Living does not warrant that any replacement material will match or be identical to the original Product as replacement products may vary in color or gloss in comparison to the original Product as a result of normal weathering.

Transferee Coverage: Limited lifetime warranty coverage will be extended to one (1) transferee with the following limitations: the one (1) transfer shall only be from residential homeowner (original Product purchaser) to a second homeowner. After a transfer, the warranty is valid thirty (30) years from the date of the original purchase.

The thirty (30) year limited warranty for commercial installations cannot be transferred.

Registration: To activate this warranty, fill out the product registration form on the website listed below, or mail a completed registration card to Barrette Outdoor Living. Registration of Product must be within thirty (30) days from date of Product purchase for warranty to be valid.

Except as expressly set forth in this warranty, Barrette Outdoor Living HEREBY EXPRESSLY DISCLAIMS ANY REPRESENTATION, WARRANTY, PROMISE, GUARANTEE OR OTHER ASSURANCE OF ANY KIND, EXPRESS OR IMPLIED, ORAL OR WRITTEN, STATUTORY OR OTHERWISE, RELATING TO THE PRODUCT. STATE LAW WILL DETERMINE THE PERIOD OF TIME FOLLOWING THE SALE THAT YOU MAY SEEK A REMEDY UNDER THE IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

NO DISTRIBUTOR, DEALER OR OTHER PERSON IS AUTHORIZED BY BARRETTE OUTDOOR LIVING TO CHANGE THIS WARRANTY OR TO MAKE ANY ADDITIONAL REPRESENTATION, WARRANTY, PROMISE, GUARANTEE OR OTHER ASSURANCE ON BEHALF OF BARRETTE OUTDOOR LIVING RELATING TO THE PRODUCT. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY STATE TO STATE.

 

LIMITATION OF LIABILITY: THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND BARRETTE OUTDOOR LIVING’S ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. 30-Year Limited Residential Warranty 

10-Year Limited Commercial Warranty

Statement of Warranty: This warranty is given to either (1) the original purchaser or (2) the owner(s) of the property at the time of installation, if different from the original purchaser (collectively hereinafter “Purchaser”), of PRO™ alternative decking materials (including the Terrain™, Tropical and Legacy Collections) manufactured by The AZEK Company LLC (hereinafter “Manufacturer”). For purposes of this warranty, a “Residential Purchaser” shall refer to a single-family residential homeowner and a “Commercial Purchaser” shall refer to any Purchaser other than a single-family residential homeowner.

Except as set forth in the exclusions, limitations and restrictions set forth below, Manufacturer warrants to a Residential Purchaser that for a period of thirty (30) years (10 years for a Commercial Purchaser), the Products will, from the date of the original purchase, be free from material defects in workmanship and materials that (1) occur as a direct result of the manufacturing process, (2) occur under normal use and service, (3) occur during the warranty period and (4) result in splitting, splintering, rotting or structural damage from termites or fungal decay.

Exclusions from Warranty Coverage: Manufacturer does not warrant against and is not responsible for, and no implied warranty shall be deemed to cover, any product failure, product malfunction, or damages attributable to: (1) improper installation of the Products and/ or failure to abide by the Manufacturer’s installation guidelines, including but not limited to improper gapping; (2) use of the Products beyond normal use, or in an application not recommended by the Manufacturer’s installation guidelines and/or local building codes; (3) movement, distortion, collapse or settling of the ground or the supporting structure on which the Products are installed; (4) any act of God (such as flooding, hurricane, earthquake, lightning, etc.), environmental condition (such as air pollution, mold, mildew, etc.), or staining from foreign substances (such as dirt, oil, etc.); (5) variations or changes in color of Products; (6) normal weathering of surfaces; (7) improper handling, storage, abuse or neglect of the Products by Purchaser, the transferee or third parties; (8) exposure to, or direct or indirect contact with extreme heat sources including reflected sunlight from low-emissivity (Low-E) glass which may damage the surface of the product and/or cause the Product to fade; (9) fabrication or remanufacturing by third parties; (10) minor dripping from DrySpace; (11) any fasteners not supplied by Manufacturer; or 12) improper application of paint or other surface chemicals not recommended by the Manufacturer in writing;

Purchaser is solely responsible for determining the effectiveness, fitness, suitability and safety of the Products in connection with their use in any particular application.

Obtaining Warranty Performance: If Purchaser discovers a defect in any of the Products covered under this Limited Warranty during the applicable warranty period, Purchaser must, within thirty (30) days from the discovery of the alleged defect, but no later than the end of the applicable warranty period, notify Manufacturer. Purchaser may notify Manufacturer of a warranty claim using TimberTech’s online warranty claim form process available at http://TimberTech.com/warranty/warranty-claims-center. Alternatively, Purchaser may submit a warranty claim by contacting the Manufacturer in writing at the following address:

Purchaser must include in this notification proof of purchase and a statement explaining the defect. Manufacturer may request additional information. After reviewing all information, Manufacturer will make a determination regarding the validity of such claim. If Manufacturer determines Purchaser’s claim is valid, Manufacturer will, at its option, either replace the defective Products or refund the portion of the purchase price paid by Purchaser for such defective Products (not including the cost of its initial installation). Replacement material will be provided that is as close as possible in color, design and quality as the replaced material, but Manufacturer does not guarantee an exact match as colors and design may change. In the event of repair or replacement, the original warranty shall apply to the repaired or replaced portion of the Products and will extend for the balance of the warranty period in effect at the time the material proved defective.

If a Residential Purchaser makes a valid warranty claim during years eleven (11) through thirty (30) after the original purchase date, then the Residential Purchaser’s recovery will be prorated as indicated below. If Manufacturer is providing replacement materials, it may elect to replace the percentage listed below of Products; if Manufacturer is refunding the purchase price, it may elect to refund the percentage listed below of the purchase price of the Products

Transfer of Warranty: This warranty may be transferred one (1) time, within the five (5) year period beginning from the date of original purchase by Purchaser, to a subsequent buyer of the property upon which the Products were originally installed.

Limitations: DISCLAIMER Of WARRANTIES: EXCEPT FOR (1) THE EXPRESS WRITTEN WARRANTY CONTAINED HEREIN, MANUFACTURER MAKES NO OTHER WARRANTIES, GUARANTEES OR INDEMNITIES, WHETHER EXPRESS OR IMPLIED, ARISING BY LAW, COURSE OF DEALING, USAGE OF TRADE, CUSTOM OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTY OF MERCHANTABILITY AND IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, AND ALL SUCH OTHER WARRANTIES, GUARANTEES AND INDEMNITIES ARE HEREBY DISCLAIMED, OVERRIDDEN AND EXCLUDED FROM THIS TRANSACTION FOR THE WARRANTY TERM AND BEYOND THE WARRANTY TERM.

LIMITATION OF REMEDIES AND EXCLUSION OF CONSEQUENTIAL AND INCIDENTAL DAMAGES: MANUFACTURER’S LIABILITIES ARE LIMITED SOLELY AND EXCLUSIVELY TO THE OBLIGATIONS SPECIFICALLY UNDERTAKEN HEREIN, AND UNDER NO CIRCUMSTANCES WILL MANUFACTURER BE LIABLE OR OBLIGATED FOR ANY INCIDENTAL, CONSEQUENTIAL, INDIRECT, SPECIAL, PUNITIVE OR ANY OTHER DAMAGES OF ANY KIND WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, LOST SALES, LOSS OF GOODWILL, USE OF MONEY, USE OF GOODS, STOPPAGE OF WORK, OR IMPAIRMENT OF ASSETS), WHETHER FORESEEABLE OR UNFORESEEABLE, ARISING OUT OF BREACH OR FAILURE OF EXPRESS OR IMPLIED WARRANTY, BREACH OF CONTRACT, FRAUD, MISREPRESENTATION, NEGLIGENCE, STRICT LIABILITY IN TORT OR OTHERWISE, EXCEPT AND ONLY TO THE EXTENT THIS LIMITATION IS SPECIFICALLY PRECLUDED BY APPLICABLE LAW OF MANDATORY APPLICATION. Miscellaneous: This writing is understood and intended to be the final expression of the parties’ agreement and is a complete and exclusive statement of the terms and conditions with respect thereto, superseding all prior agreements or representations, oral or written, and all other communication between the parties relating to the subject matter of this warranty. This warranty may not be altered or amended except in a written instrument signed by Manufacturer and Purchaser or permitted transferee. No agent, employee or any other party is authorized to make any warranty in addition to that made herein and Manufacturer shall not be bound by any such statements other than those contained in this warranty. Manufacturer reserves the right to discontinue or modify the Products covered under this warranty at any time without notice. In the event that repair or replacement of the Products pursuant to this warranty is not possible, Manufacturer may fulfill any repair or replacement obligation under this warranty with a product of equal value.

This warranty is effective for purchases of Products on or after January 1, 2019.

TimberTech Limited Railing Warranty

Statement of Warranty: This warranty is given to either (1) the original purchaser or (2) the owner(s) of the property at the time of installation, if different from the original purchaser (collectively hereinafter “Purchaser”), of TimberTech rail systems, rail components and related rail products manufactured by The AZEK Company LLC (hereinafter “Manufacturer”). The products covered by this Limited Warranty include Premier Railing®, Trademark Rail™, Reserve Rail™, RadianceRail®, RadianceRail® Express, Contemporary Rail, Builder Rail, Impression Rail™, Impression Rail™ Express, ADA Rail, rail component products including infill components (composite balusters, aluminum balusters, glass channels, & CableRail by Feeney®), post sleeves, skirts & hardware, and secure mount posts (collectively “Rail Products”) as well as rail accessory products including rail lighting and gate kits (collectively “Rail Accessories”) (Rail Products and Rail Accessories shall be collectively referred to herein as “Products”). For purposes of this warranty, a “Residential Purchaser” shall refer to a single-family residential homeowner and a “Commercial Purchaser” shall refer to any Purchaser other than a single-family residential homeowner

Except as set forth in the exclusions, limitations and restrictions set forth below, Manufacturer warrants to Purchaser that for the warranty periods delineated below, the Products will, from the date of the original purchase, be free from material defects in workmanship and materials that (1) occur as a direct result of the manufacturing process, (2) occur under normal use and service, (3) occur during the warranty period and (4) result in peeling, blistering, splitting, splintering, cracking, rotting or damage from termites or fungal decay

Warranty Periods: Rail Products (25 years, prorated as set forth below, for Residential Purchaser; 10 years for Commercial Purchasers); Cable Rail (10 years for any Purchaser); Rail Accessories (5 years for any Purchaser).

 

Exclusions from Warranty Coverage: Manufacturer does not warrant against and is not responsible for, and no implied warranty shall be deemed to cover, any product failure, product malfunction, or damages attributable to: (1) improper installation of the Products and/or failure to abide by the Manufacturer’s installation guidelines; (2) use of the Products beyond normal use, or in an application not recommended by the Manufacturer’s installation guidelines and/or local building codes; (3) movement, distortion, collapse or settling of the ground or the supporting structure on which the Products are installed; (4) any act of God (such as flooding, hurricane, earthquake, lightning, etc.), environmental condition (such as air pollution, mold, mildew, etc.), or staining from foreign substances (such as dirt, grease, oil, etc.); (5) variations or changes in color of Products; (6) normal weathering due to exposure to sunlight, weather and atmosphere which can cause colored surfaces to, among other things, flake, chalk, fade, or accumulate dirt or stains; (7) improper handling, storage, abuse or neglect of the Products by Purchaser, the transferee or third parties; (8) any fasteners not supplied by Manufacturer; 9) fabrication or remanufacturing by third parties (10) discoloration, rust or tarnishing caused by exposure to corrosive elements or atmospheric contaminates such as salt spray, salt air, chemicals, and pollution*; (11) exposure to, or direct or indirect contact with extreme heat sources including reflected sunlight from low-emissivity (Low-E) glass which may damage the surface of the product and/or cause the Product to fade; or (12) improper application of paint or other surface chemicals not recommended by the Manufacturer in writing.

Manufacturer reserves the right to discontinue or modify the Products covered under this warranty at any time without notice. In the event that repair or replacement of the Products pursuant to this warranty is not possible, Manufacturer may fulfill any repair or replacement obligation under this warranty with a product of equal value.

TimberTech Lighting Warranty

5-Year Limited Lighting Warranty

Statement of Warranty: This warranty is given to either (1) the original purchaser or (2) the owner(s) of the property at the time of installation, if different from the original purchaser (collectively hereinafter “Purchaser”) of TimberTech Lighting Products (“Lighting Products”) manufactured by The AZEK Company LLC (hereinafter “Manufacturer”).

Manufacturer warrants to Purchaser that for a period of five (5) years from the date of original consumer purchase (the “Term”), the Lighting Products will be free from defects in material and workmanship that (1) occur as a direct result of the manufacturing process, (2) occur under normal use and service, (3) occur during the warranty period and (4) result in the Lighting Products failing to operate normally.

All warranties are subject to the exclusions, limitations and restrictions set forth below

Obtaining Warranty Performance: If Purchaser discovers a defect in the Lighting Products during the Term, Purchaser must, within thirty (30) days from the discovery of the alleged defect but no later than the end of the Term, notify Manufacturer of a warranty claim using TimberTech’s online warranty claim form process available at http://TimberTech.com/warranty/warranty-claims-center. lternatively, purchaser may submit a claim by contacting the Manufacturer at the following address:

Purchaser must include in this notification proof of purchase and a statement explaining the defect. Manufacturer may request additional information. After reviewing all information, Manufacturer will make a determination regarding the validity of such claim. If Manufacturer determines that Purchaser’s claim is valid, Manufacturer will, at its option, either replace the defective Lighting Products or refund the portion of the purchase price paid by Purchaser for such defective Lighting Products (not including the cost of its initial installation). If Manufacturer determines Purchaser’s claim is valid, Manufacturer will, at its option, either replace the defective Products or refund the portion of the purchase price paid by Purchaser for such defective Products (not including the cost of its initial installation). Replacement material will be provided that is as close as possible in color, design and quality as the replaced material, but Manufacturer does not guarantee an exact match as colors and design may change. In the event of repair or replacement, the original warranty shall apply to the repaired or replaced portion of the Products and will extend for the balance of the warranty period in effect at the time the material proved defective. This warranty shall not cover, and Manufacturer shall not be responsible for, costs and expenses incurred with respect to the removal of the defective Lighting Products or the installation of replacement materials, including but not limited to, labor and freight. The foregoing remedies are the SOLE AND EXCLUSIVE REMEDY FOR BREACH OF ANY WARRANTY.

Transfer of Warranty: This warranty may be transferred one (1) time within the Term to a subsequent buyer of the property upon which the Lighting Products were originally installed. Transfer of this warranty does not extend the Term of the warranty.

Exclusions from Warranty Coverage: Manufacturer does not warrant against and is not responsible for, and no implied warranty shall be deemed to cover, any damage or loss attributable to: (1) improper installation of Lighting Products and/or failure to abide by the Manufacturer’s Installation Guidelines; (2) use of Lighting Products in an application not recommended by the Manufacturer’s Installation Guidelines (including, but not limited to, immersion or submersion of the Lighting Products in water) and local building codes; (3) any act of God (such as flooding, hurricane, earthquake, lightning (or other incidences of excessive voltage), natural disaster, etc.), environmental condition (such as air pollution, mold, mildew, etc.), or staining from foreign substances (such as dirt, grease, oil, etc.); (4) variations or changes in color of lighting; (5) normal weathering due to exposure to sunlight, weather and atmosphere which can cause colored surfaces to, among other things, flake, chalk, or accumulate dirt or stains; (6) improper handling, storage, abuse or neglect of Lighting Products by Purchaser, the transferee or third parties; (7) use in harsh industrial or marine environments; or (8) use of any fasteners with the Lighting Products which were not supplied by TimberTech or AZEK. 

 

Purchaser is solely responsible for determining the effectiveness, fitness, suitability and safety of Lighting Products in connection with their use in any particular application.

 

Limitations: DISCLAIMER OF WARRANTIES: EXCEPT FOR THE EXPRESS WRITTEN WARRANTY CONTAINED HEREIN, AZEK BUILDING PRODUCTS MAKES NO OTHER WARRANTIES, GUARANTEES OR INDEMNITIES, WHETHER EXPRESS OR IMPLIED, ARISING BY LAW, COURSE OF DEALING, USAGE OF TRADE, CUSTOM OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTY OF MERCHANTABILITY AND IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, AND ALL SUCH OTHER WARRANTIES, GUARANTEES AND INDEMNITIES ARE HEREBY DISCLAIMED, OVERRIDDEN AND EXCLUDED FROM THIS TRANSACTION. Some states do not allow limitations on how long an implied warranty lasts so the above limitation may not apply to you.

Miscellaneous: This writing is understood and intended to be the final expression of the parties’ agreement and is a complete and exclusive statement of the terms and conditions with respect thereto, superseding all prior agreements or representations, oral or written, and all other communication between the parties relating to the subject matter of this agreement. This limited warranty may not be altered or amended except in a written instrument signed by Manufacturer and Purchaser or permitted transferee. No agent, employee or any other party is authorized to make any warranty in addition to that made in this agreement and Manufacturer shall not be bound by any such statements other than those contained in this warranty

Statement of Warranty: This warranty is given to either (1) the original purchaser or (2) the owner(s) of the property at the time of installation, if different from the original purchaser (collectively hereinafter “Purchaser”), of TimberTech® ReliaBoard, TwinFinish and DockSider alternative decking materials manufactured by The AZEK® Company LLC (hereinafter “Manufacturer”) For purposes of this warranty, a “Residential Purchaser” shall refer to a single-family residential homeowner and a “Commercial Purchaser” shall refer to any Purchaser other than a single-family residential homeowner.

Except as set forth in the exclusions, limitations and restrictions set forth below, Manufacturer warrants to a Residential Purchaser that for a period of thirty (30) years (10 years for a Commercial Purchaser), the Products will, from the date of the original purchase, be free from material defects in workmanship and materials that (1) occur as a direct result of the manufacturing process, (2) occur under normal use and service, (3) occur during the warranty period and (4) result in splitting, splintering, rotting or structural damage from termites or fungal decay.

Exclusions from Warranty Coverage: Manufacturer does not warrant against and is not responsible for, and no implied warranty shall be deemed to cover, any product failure, product malfunction, or damages attributable to: (1) improper installation of the Products and/ or failure to abide by the Manufacturer’s installation guidelines, including but not limited to improper gapping; (2) use of the Products beyond normal use, or in an application not recommended by the Manufacturer’s installation guidelines and/or local building codes; (3) movement, distortion, collapse or settling of the ground or the supporting structure on which the Products are installed; (4) any act of God (such as flooding, hurricane, earthquake, lightning, etc.), environmental condition (such as air pollution, mold, mildew, etc.), or staining from foreign substances (such as dirt, oil, etc.); (5) variations or changes in color of Products; (6) normal weathering of surfaces; (7) improper handling, storage, abuse or neglect of the Products by Purchaser, the transferee or third parties; (8) exposure to, or direct or indirect contact with extreme heat sources including reflected sunlight from low-emissivity (Low-E) glass which may damage the surface of the product and/or cause the Product to fade; (9) fabrication or remanufacturing by third parties; (10) minor dripping from DrySpace; (11) any fasteners not supplied by Manufacturer; or 12) improper application of paint or other surface chemicals not recommended by the Manufacturer in writing;

Purchaser is solely responsible for determining the effectiveness, fitness, suitability and safety of the Products in connection with their use in any particular application.

Fortress Railing Products Warranty

Fortress Railing Products warrants its FortressShield protected Fe26 Iron Railing products and accessories to be free from manufacturing defects in material and workmanship to the original consumer purchaser for a period of 15 years from the date of purchase.  In addition to manufacturing defects, this Limited Warranty covers cracking, peeling and blistering of the finish and extensive corrosion of the Fe26 Iron Railing products.  Corrosion is termed extensive when there are multiple rust-through perforation instances on the same piece of product.

This warranty does not cover damage caused by abnormal or improper use, improper product application, accident, alteration, welding, neglect, abuse, lawn care equipment damage, abrasion, harsh chemicals, pool chemicals or chemicals for ice removal, air pollutants, improper service or installation or lack of service, or damage cause by flood, fire or acts of God.  Surface corrosion from scratches, nicks and dents are not covered.  For product located 1 mile or less from the coast line, this Limited Warranty is for a period of 1 year from the date of purchase.  FortressShield protected Fe26 Iron Railing products that have had direct contact with salt water are excluded from this limited warranty.

The original consumer purchaser must contact Fortress Railing Products’ customer service directly via phone at (866) 323-4766 or via email at warranties@fortressrailing.com to obtain necessary warranty claim forms and the official claim process.  The original consumer purchaser will be notified by Fortress Railing Products as to whether the warranty claim is approved or denied.  PROOF OF PURCHASE TAG INCLUDED WITH ALL FORTRESS RAILING PRODUCTS AND ORIGINAL RECEIPT/INVOICE MUST ACCOMPANY ALL WARRANTY CLAIMS.

Conditions and Exclusions of this warranty

THIS WARRANTY IS NOT TANSFERRABLE.  SOME DARKENING OF THE ANTIQUE BRONZE COLOR IS EXPECTED OVER TIME, AND THIS IS NOT A WARRANTY RELATED ISSUE.  THE AMOUNT OF YOUR RESTITUTIONL WILL NOT INCLUDE LABOR TO REMOVE EXISTING COMPONENTS OR INSTALL THE REPLACEMENT COMPONNETS, SHIPPING CHARGES, SALES TAX OR ANY OTHER CHARGES, NOR IS FORTRESS RAILING PRODUCTS REQUIRED TO PROVIDE SUCH LABOR OR SERVICE.

THIS LIMITED WARRANTY IS IN LIEU OF ALL OTHER EXPRESS WARRANTIES.  FORTRESS RAILING PRODUCTS MAKES NO OTHER EXPRESS WARRANTIES AND DOES NOT AUTHORIZE ANY OTHER PERSON OR AGENT TO MAKE ANY OTHER EXPRESS WARRANTIES.  FORTRESS RAILING PRODUCTS NEITHER ASSUMES NOR AUTHORIZES ANY OTHER LIABILITY OR OBLIGATION IN WARRANTY.  INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT TO THIS PRODUCT.  IN NO EVENT SHALL FORTRESS RAILING PRODUCTS BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, OR INCIDENTAL DAMAGES ARISING OUT OF OR CONNECTED WITH THE PURCHASE OR USE OF THIS PRODUCT OF FOR ANY BREACH OF WARRANTY.

This Agreement shall be governed by and construed in accordance with the laws of the the State of Texas, without regard to its conflict of laws.  Any legal action arising out of this Agreement shall be litigated and enforced under the laws of the State of Texas.  In addition, you agree to submit to the jurisdiction of the courts of the State of Texas, and that any legal action pursued by you shall be within the exclusive jurisdiction of the courts of the State of Texas, and that any legal action pursued by you shall be within the exclusive jurisdiction of the courts in the State of Texas, U.S.A.

SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, OR THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSION MAY NOT APPLY TO YOU.  THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE.  THIS WARRANTY IS APPLICABLE ONLY TO SSTEMS INSTALLED WITHIN THE CONTINENTAL UNITED STATES AND CANADA.

Ameristar Warranty

MONTAGE WELDED ORNAMENTAL FENCE WARRANTY —

Ameristar’s Montage® welded ornamental fences are manufactured from the highest quality materials by skilled craftsmen to meet the highest standards of workmanship in the industry.  Galvanized steel framework is subjected to a multi-stage pretreatment/wash (with zinc phosphate), followed by a duplex cathodic electro-coat system consisting of an epoxy primer, which significantly increases corrosion protection, and an acrylic liquid topcoat, which provides the protection necessary to withstand adverse weathering effects.

The electro-coated surface on all Montage welded ornamental panels and posts are guaranteed under normal and intended usage, against cracking, peeling, chipping, blistering or corroding commencing with the original purchase date and extending according to the applications defined in the tables below.  Normal and intended usage does not include physical damage, abrasion, or heavy salt spray exposure to the protective coating.

The following acts and/or omissions will void the subject warranty:

  • Damage to the product caused by the property owner by use of landscape, gardening equipment, chemicals that may cause damage, and/or water sprinklers with high mineral content;
  • Damage caused by allowing plant life of any sort to grow directly upon or in contact with any portion of the product or sap from trees;
  • Any alteration to the product itself by the property owner including any on-site cutting or welding; and/or, failure to follow any and all maintenance instructions provided by Ameristar® at the time of sale to the original purchaser even if these instructions are not forwarded to the ultimate claimant under this warranty.
  • When cutting Montage immediately seal the exposed surfaces by 1) Removing all metal shavings from the cut area 2) Applying zinc-rich primer to thoroughly cover cut edge and drilled hole and, after letting dry, 3) Applying two (2) coats of custom finish spray paint matching fence color. Failure to seal exposed surfaces per steps 1-3 above will negate warranty.
  • If contractor uses non-Ameristar parts/components, this will negate the warranty.

Ameristar Montage welded ornamental fences are also guaranteed for the same period of time against defects in workmanship or materials.  Should any Montage welded ornamental panel or post manufactured by Ameristar fail in accordance with any of the above conditions, Ameristar warrants to the original purchaser their redemption through replacement, renewal, or issuance of a pro-rated credit.  The choice of redemption method is solely at the discretion of Ameristar.  If the pro-rated alternative is chosen, the amount will be based on the original cost of materials at the date of purchase multiplied by the appropriate time and exposure factor from the table below:

Note: Regardless of location and years in service, evidence of historical salt spray exposure shall be considered as grounds to void any warranty obligations.

Notice of failure under the conditions of this warranty shall be sent to Ameristar or its authorized representative, in writing, together with proof of purchase and shall specify the nature of the defect and when it was first observed as well as photographs of current site conditions.  Should the fence be improperly installed, Ameristar shall not be responsible for guaranteed performance or appearance of the material.  Neither does this guarantee apply when failure or damage is due to improper use or application, abuse or misuse, salt spray exposure (see Table and Note above), vandalism, or acts of God.  Ameristar reserves the right to inspect the material to determine validity of the claim.

Upon acceptance of the claim by Ameristar or its authorized representative, redemption by replacement, renewal or issuance of a pro-rated credit shall be made by Ameristar.  Reimbursement for labor necessary to restore and/or replace components that have been found defective under the terms of this warranty is guaranteed to the original purchaser for a period of five (5) years form the original purchase date.  Ameristar reserves the right to select the qualified company or individual to perform the labor to repair or replace the components that are deemed to be defective under the terms of this warranty.

The above constitutes the complete warranty by the manufacturer.  No other agreement, written or implied, is valid.  Ameristar Fence Products does not authorize any other person or agent to make any other express warranties.  Ameristar neither assumed nor authorizes any other person or agent to assume any other liability in connection with the Montage welded ornamental fence system.

SOUTHWESTERN WIRE, INC. WARRANTY —

  1. This limited warranty covers chain link fence fabric made form “Class IV” (1.2 oz./ft.2) zinc coated wire. Manufacturer specifically warrants:
    1. That the wire used in the manufacture of this product meets the specifications set forth by the American Society for Testing and Material (ASTM) A817-91 for Type II Class I zinc coated steel wire, AASHTO designation M181-86 for Type I Class C; and
    2. That the Fence Fabric is guaranteed to a period of fifteen years against failure resulting from natural red rust or corrosion under normal light commercial or residential conditions. Failure is defined as structural failure of the wire resulting in loss of specific tensile strength or fracture of the wire.

IN NO EVENT WILL THE MANUFACTURER BE LIABLE FOR:

  • Damage resulting from abnormal use, abuse, neglect, fire, flood, accident or Act of God.
  • Accelerated corrosion resulting from atmospheres or abnormally harsh environments such as: chemicals, salt spray, animal waste and other known or unknown chemical or organic corrosives.
  • The cost of installation, removal, or re-installation of this product.
  1. FOR BREACH OF ANY WRITTEN OR IMPLIED WARRANTY ON THIS PRODUCT, THE PURCHASER IS LIMITED TO THE FOLLOWING DAMAGES: repair or replacement cost as stated in Paragraph 5 below. NOTE: SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES.  SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
  1. This limited warranty extends exclusively to the original purchaser of the warranted product. The term of this warranty begins on the original date of purchase by the purchaser and continues for a period of fifteen years.
  1. In the event of a defect, or other failure of the product not caused by any misuse or damage to the product while in the possession of the purchaser, the Manufacturer will remedy the failure or defect, without charge to the purchaser, within 60 days. The remedy will consist of repair or replacement of the product, or refund of the purchase price, at the Warrantor’s option.  However, the Warrantor will not elect refund unless it is unable to provide replacement, and repair is not commercially practicable or cannot be made with the time for performance.
  1. If this product or one of its component parts contains a defect or malfunction, the purchaser shall notify Manufacturer in writing at P.O. Box CC, Norman, OK 73070, describing the defect or malfunction and providing copies of the original sales receipt and tag from the defective or malfunctioning fabric. After a reasonable number of attempts by the Manufacturer to remedy the defect or malfunction, the purchaser is entitled to either a refund or replacement of the product or its component part or parts, at the election of the purchaser.  The Manufacturer reserves the right to inspect and/or test any product claimed to be defective.  Before the purchaser is entitled to the remedies referred to herein for breach of warranty, the Manufacturer must determine to its satisfaction that the product is (a) Product made by the Manufacturer; and (b) defective.
  1. As a condition to enforcement of this limited warranty, to obtain performance of any obligation under this warranty, the purchaser shall:
    1. Complete the pre-addressed Warranty Registration card and return it to Southwestern Wire, Inc.
    2. Keep the original sales receipt for proof of purchase; and
    3. Clip and save the tags on each roll of fabric.
  1. This limited warranty gives you specific legal rights, and you may also have other rights that vary from state to state.

THIS LIMITED WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED BY LAW, INCLUDING THE IMPLIED WARRANTY OF MERCHANTABILITY.
